CHOW TAI FOOK MEMBERSHIP TERMS AND CONDITIONS

These terms and conditions apply to the Chow Tai Fook Membership Programme in Hong Kong and Macau ("Programme"). It is the responsibility of any person applying to be a member ("Applicant") and each member of the Programme ("Member") to read and understand them.


These terms and conditions must be read in conjunction with any other terms and conditions set out in any membership card including any electronic membership card, any coupon including reward coupon, the Programme handbook, the Programme website ("Website"), Chow Tai Fook Membership Program mobile applications (“Applications”) and other documents as provided by Chow Tai Fook Jewellery Company Limited and/or its subsidiaries or affiliates (collectively "Chow Tai Fook" or “CTF”) from time to time (together, including these terms and conditions, the "Terms").


By submitting a completed Application Form or otherwise becoming a Member, an Applicant acknowledges that he/she has read, understood and agrees to comply with all of the Terms.

1. OVERVIEW OF THE PROGRAMME AND GENERAL TERMS AND CONDITIONS

1.1 The Programme is offered and managed by Chow Tai Fook.

 

1.2 The Programme offers different membership tiers, including Follower, Basic, Gold, Platinum and Diamond memberships.

 

1.3 Without limiting Chow Tai Fook's rights under the Terms, in particular its rights of suspension and termination, Members must comply with all of the Terms in order to maintain their memberships and enjoy the benefits and privileges granted to Members.

 

1.4 Chow Tai Fook reserves the right to amend, supplement or otherwise revise the Terms at any time without any prior notice to Members. In the event of any inconsistencies between the Terms, the terms and conditions as set out on the Website will prevail, unless specifically stated otherwise. Use of the Website is further subject to the legal and privacy terms found on the website.

 

1.5 Membership is not transferable and may only be used by the named Member. Misuse of Programme benefits and privileges may result in the suspension or termination of membership or the withdrawal or forfeiture of benefits and privileges(including accrued benefits and rewards).

 

1.6 Members are required to inform Chow Tai Fook of any change in personal particulars as soon as reasonably practicable, but always in accordance with the Terms, either:i) in person at any Chow Tai Fook store in Hong Kong or Macau (excluding Hong Kong Disney and Hong Kong Disney Castle stores) ("Chow Tai Fook Store") by completing the "Member Information Update Form" and returning the completed form to any Chow Tai Fook Store; orii) make data changes from the "My Profile" page of the Website or the Applications. Members are responsible for providing their updated mobile numbers and email addresses to Chow Tai Fook. Chow Tai Fook shall not be responsible for any loss or liability incurred by the Members as a result of the Members’ failure to notify Chow Tai Fook of any change of their mobile numbers and email addresses.

 

1.7 Programme membership and information relating to membership such as the amount of a Member's Qualifying Spending (as defined below) will be kept in Chow Tai Fook's records and such records will be conclusive evidence and the sole basis for the calculation and determination of all Member benefits and privileges.

 

1.8 In the event of any dispute arising out of or relating to the Programme or individual membership, Chow Tai Fook reserves the right to make sole and final decisions.

2. ELIGIBILITY FOR MEMBERSHIP AND APPLICATIONS

2.1 Any individual, natural person aged 18 or above can register as a Chow Tai Fook Member. Any above-mentioned person who makes a single-transaction purchase at or above the amount (“Initial Purchases”) specified by Chow Tai Fook from time to time (excluding gift vouchers, pure gold nuggets, corporate gift orders and deposits) at any ChowTai Fook Store may apply to become a Basic member and start to accumulate spending to qualify for a higher membership status ("Qualifying Spending") or, if the Qualified Spending already meets the requirements for Gold, Platinum or Diamond membership, the relevant membership can be upgraded.


2.2 Once Applicant’s Initial Purchases reach the specified amount and successfully become a Member above the Basic membership level, the Initial Purchases will be converted into Initial Purchases Points (as defined below under paragraph 5 of these terms and conditions) and the Initial Purchases Points will be deposited immediately into his/her Programme account (“Account”). In any circumstances, if Member is removed from the Programme caused by cancelations of Initial Purchases for whatever reason, the Initial Purchases Points of that Member shall be forfeited.


2.3 Membership in the Programme is for individual, natural persons only. Joint or duplicate applications, or applications made by or on behalf of any companies, corporations, partnerships, businesses, legal entities or other organizations will not be accepted.

 

2.4 Members can enroll in both the Programme and the Chow Tai Fook Membership Programme in Mainland China. However, each programme and membership is unrelated and independent of the other, and cannot be used or combined with the other. For the avoidance of doubt, the accumulated Qualifying Spending and the Points (as defined below) in each membership account shall be calculated separately and without consideration of the other.

 

2.5 To apply for membership, Applicants can access the “My account” page of the Website ("Page") from the following four channels. Applicants need to register their mobile phone numbers and/ or email address in order to set up the Programme accounts to become Members. Each person can only apply for one member account and each valid mobile phone number can only be registered once.

i. The Applications;

ii. The Programme website;

iii. Chow Tai Fook e-Shop website; or

iv. visit any Chow Tai Fook Store.

 

2.6 The Applicants must complete all mandatory items on the Page and provide true and accurate information. Chow Tai Fook reserves the right not to consider or process any incomplete or incorrectly filled application and reserves the absolute right to refuse any membership applications without giving any reason.

 

2.7 Upon successful application, the Applicant will receive a one-time SMS verification code (“Code”) or the Applicant can conduct SMS or email verification when logging in to the account through the Website or the Applications. The Applicant is required to enter the code within the specified time to complete the Membership registration process to become a Member. The Applicant who fails to complete the Membership registration process will only be able to use the points earned on the same day.

 

2.8 Chow Tai Fook has the sole and final right to approve or reject any membership application regardless of whether an applicant has met any or all of the criteria for the membership application.

3. MEMBERSHIP PERIOD; QUALIFYING SPENDING AND MEMBERSHIP UPGRADE, DOWNGRADE AND RENEWAL

3.1 A Member's Qualifying Spending is accumulated within the membership period applicable to the Member's membership tier ("Membership Period").
The Membership Period for the Basic, Gold, Platinum and Diamond membership tier is 24 months from the date of Chow Tai Fook's approval of an application or membership upgrade as the case may be (based on Chow Tai Fook's records).

 

3.2 Qualifying Spending:

i) must be made in a Chow Tai Fook Store or Chow Tai Fook eShop and cannot be made through any other channels;
ii) excludes gift vouchers, pure gold nuggets, corporate gift orders and deposits (and any other item determined by Chow Tai Fook from time to time in its sole discretion);
iii) to be accumulated, requires presentation of a valid electronic or physical membership card prior to purchase, and purchases of qualifying items must be claimed as Qualifying Spending by the Member on the day of purchase by the presentation of same-day receipt(s). For the avoidance of doubt, any spending which is not claimed on the same day of purchase will be forfeited and will not be subsequently credited to the Account as Qualifying Spending
iv) shall be debited and deducted from the Member's Qualifying Spending balance for any void or buy-in transactions.

 

3.3 All Qualifying Spending is non-transferable and accumulated Qualifying Spending amongst different membership accounts cannot be combined.

 

3.4 At the end of each Membership Period, or after any downgrade of a membership tier, the Member's Qualifying Spending balance will be reset to zero.

 

3.5 Members will be immediately upgraded to a new membership tier on the accumulation of the required Qualifying Spending for the relevant membership tier.

 

3.6 Once a membership is upgraded or downgraded, the effective new membership period will be two years from the date of upgrade or downgrade, whichever is applicable.

 

3.7 For Basic members, the qualifying period for an upgrade to a higher membership tier is the period of accumulated Qualifying Spending between an applicable start and end date where the end date is the current spending date and the start date is determined as follows:

i) taking the current spending date and adding one day;
ii) using the month corresponding to that new date as the starting month in the preceding two years; and
iii) using the 1st day of that starting month as the starting date for the qualifying period of Basic membership.

THE BASIC MEMBER SHALL BE UPGRADED WITH IMMEDIATE EFFECT IF THE QUALIFYING SPENDING ACCUMULATED FROM THE 1ST DAY OF THE STARTING MONTH TO THE CURRENT SPENDING DATE QUALIFIES FOR A HIGHER MEMBERSHIP TIER. FOR EXAMPLE:

3.8 Membership will automatically be renewed for two years for all Members who have accumulated the relevant Qualifying Spending required for that membership tier within the relevant Membership Period (based solely on Chow Tai Fook's records). Otherwise, the membership will be downgraded to one membership tier. For the avoidance of doubt, a Gold Member who is downgraded will be downgraded to a Basic member.
4. REWARD COUPONS/COUPONS ("COUPONS")

4.1 Members must present their valid electronic or physical membership card to earn Coupons.

 

4.2 Coupons are awarded on the same day of the relevant purchase. No Coupon will be issued or credited after the date of purchase. The award of Coupons is subject to all applicable terms.

 

4.3 Reward Coupons are calculated based on the independent net spending amount of each product purchased and invoices cannot be combined and if the net spending amount has decimal places, it shall be rounded down to the nearest integer ("Coupon Rebate Amount"). The minimum Coupon Rebate Amount shall be fifty Hong Kong dollars in order for Coupons to be issued. The calculation of Coupon amounts to be issued shall be rounded down to the nearest fifty Hong Kong dollars based on the Coupon Rebate Amount.

 

4.4 Purchases of pure gold products, gift vouchers, pure gold nuggets, loose stones, watches, corporate gift orders or deposits (and any other item determined by Chow Tai Fook from time to time in its sole discretion) are not included in the calculation of Coupons amounts.

 

4.5 If a Coupon is lost, no replacement will be provided. Coupons are invalid and will not be re-issued if, in Chow Tai Fook's absolute sole discretion, they are defaced or damaged.

 

4.6 Coupons can only be used in a Chow Tai Fook Store.

 

4.7 Coupons are valid subject to the expiry date shown on the specific Coupon.

 

4.8 Coupons must be presented at the time of purchase prior to payment and cannot be used for a purchase after payment for that purchase has been made.

 

4.9 The use of Coupons is subject to all applicable Terms, including any terms provided with or referenced on the Coupon, and any terms and conditions relating to void, buy-in or exchange transactions.

 

4.10 Coupons cannot be used or spent in any way except in accordance with the Terms and any additional terms and conditions as advised by Chow Tai Fook from time to time.

 

4.11 No exchange, refund, replacement or redemption for cash, payment of accounts or otherwise will be given in any manner or form for any unspent or unused value (if any) of a Coupon.

 

4.12 Coupons cannot be used in any manner or form in conjunction with any other discount, coupon, promotional offer or during our sales periods.

 

4.13 Coupons cannot be used in any manner or form for pure gold products, gift vouchers, pure gold nuggets, loose stones, watches, corporate gift orders or deposits (and any other item determined by Chow Tai Fook from time to time in its sole discretion).

 

4.14 The calculation of refund amounts in respect of void transactions (e.g. transactions cancelled on the same day of purchase) and buy-in transactions (e.g. returns of merchandise)shall be net of the amount of any Coupons used in the original purchase transaction.

 

4.15 The calculation of cash amounts required to top up in the event of any exchange purchase transaction (e.g. the exchange of a purchased item for another item of higher value) shall include the additional amount of any Coupons originally used. For the avoidance of doubt, exchange transactions shall require the Member to top up in cash the following two amounts:

i) the difference in price between the item of higher value and the exchanged item's current market value; and
ii) the amount of the Coupon originally used.

5. CTF POINTS ("POINTS")

5.1 Members must present their valid electronic or physical membership cards to earn or use Points.

 

5.2 All Members must accumulate or use the Points by scanning the QR code through the Applications, showing Code or other methods provided by Chow Tai Fook from time to time at the time of purchase at the Chow Tai Fook Store. The entire transaction can only be recorded in one Account (the account used at the time of purchase) and cannot be split.

 

5.3 Points are calculated based on the independent net spending amount of each product purchased and invoices cannot be combined and if the net spending amount has decimal places, it shall be rounded down to the nearest integer.

 

5.4 Purchases of pure gold products, gift vouchers, pure gold nuggets, loose stones, watches, corporate gift orders or deposits (and any other item determined by Chow Tai Fook from time to time in its sole discretion) are not included in the calculation of Points amounts.

 

5.5 Points can only be used in Chow Tai Fook Store in Hong Kong or Macau (excluding Cloud Kiosk, Chow Tai Fook eShop, Hong Kong Disney and Hong Kong Disney Castle branches).

 

5.6 Points are valid subject to the expiry date shown on the Applications.

 

5.7 Points must be presented at the time of purchase prior to payment and cannot be used for a purchase after payment for that purchase has been made.

 

5.8 The use of Points is subject to all applicable Terms, including any terms and conditions relating to void, buy-in, or exchange transactions.

 

5.9 Points cannot be used or spent in any way except in accordance with the Terms and any additional terms and conditions as advised by Chow Tai Fook from time to time.

 

5.10 No exchange, refund, replacement or redemption for cash, payment of accounts or otherwise will be given in any manner or form for any unspent or unused value (if any, based solely on Chow Tai Fook's records) of Points.

 

5.11 Points cannot be used in any manner or form in conjunction with any other discount, coupon, and promotional offer or during our sales periods.

 

5.12 Points cannot be used in any manner or form for pure gold products, gift vouchers, pure gold nuggets, loose stones, watches, corporate gift orders or deposits (and any other item determined by Chow Tai Fook from time to time in its sole discretion).

 

5.13 The calculation of refund amounts in respect of void transactions(e.g. transactions canceled on the same day of purchase) and buy-in transactions (e.g. returns of merchandise) shall be net of the amount of any Points used in the original purchase transaction. Points earned from void transactions and buy-in transactions will be deducted from the Account. If the Account balance of the Points is insufficient for such deduction, the shortfall will be settled by the payments to be refunded accordingly.

 

5.14 The calculation of cash amounts required to top up in the event of any exchange purchase transaction (e.g. the exchange of a purchased item for another item of higher value) shall include the additional amount of any Points originally used and/or rewarded. For the avoidance of doubt, exchange transactions shall require the Member to top up in cash the following two amounts:

 

i) the difference in price between the item of higher value and the exchanged item's current market value; and

ii) the amount of the Points originally used and/or rewarded (if there are insufficient Points to return in the event of any exchange transactions).

 

5.15 Applicants can check their Points balance in the Applications and the Points balance is subject to Chow Tai Fook's records. In the event of any dispute relating to the Membership accounts and the Points matters, Chow Tai Fook reserves the right to make sole and final decisions.

 

5.16 Applicants are fully responsible for keeping and securing their Account and password. Chow Tai Fook shall not be liable for any loss or damage suffered directly or indirectly by Members as a result of and/or in relation to the loss or theft of a mobile phone installed with the Account and/or its improper use of the Account or the Account password being disclosed to an unauthorized person.

 

5.17 Member can apply points transfer to another member through the “My Account” page of the Website or "the Applications" in accordance with the instructions stated. The transfer is subject to Chow Tai Fook’s approval and Chow Tai Fook reserves the right to refuse any transfer application without giving any reason. Upon confirmation of the points transfer, no amendment or cancellation will be accepted. Each member can apply for point transfer with limits stated on the Website or the “Applications”.

 

5.18 If Member wants to increase point transfer limits, please visit any Chow Tai Fook Store in person to apply. Upon confirmation of the increase in limits, the transfer limit will not be adjusted following the change in membership tier(if any).

6. MEMBERSHIP TERMINATION AND SUSPENSION

6.1 Chow Tai Fook makes no warranty or representation as to the availability of the Programme or its duration or continuity and may, in its absolute discretion, suspend or terminate the Programme and/or any membership at any time without any liability arising by reason of such action.

 

6.2 Chow Tai Fook may, in its sole discretion, immediately without notice suspend or terminate the membership of any Member who fails to comply with the terms. Upon the termination of any membership, all Qualifying Spending, benefits and privileges accrued under the membership shall be canceled and be null and void.

7. ENQUIRIES IN RESPECT OF ACCUMULATED QUALIFYING SPENDING

7.1 Members can check their Qualifying Spending via the following channels:
i) visit the Website;
ii) call the Chow Tai Fook Membership Programme Hotline (details are set out in section 11);
iii) visit any Chow Tai Fook Store; or
iv) check the Applications.

 

7.2 When making inquiries via the Chow Tai Fook Membership Programme Hotline or at a Chow Tai Fook Store, Members must provide their Membership numbers and other information as may be requested by Chow Tai Fook in order to verify the Member's identity.

8. PERSONAL DATA
Chow Tai Fook will collect, use, disclose or transfer a Members' personal data in accordance with the Privacy Statement published on its website at www.chowtaifook.com.
9. MEMBER OBLIGATIONS AND WARRANTIES

9.1 Members must not:
i) act in any way in breach of the Terms; or
ii) abuse or misuse the Programme, or any of their benefits or privileges offered or gained under the Programme, including: (a) engaging in illegal or fraudulent activities;
(b) supplying or attempting to supply false or misleading information; (c) making a misrepresentation to Chow Tai Fook or any of its subsidiaries or affiliated companies; or (d) selling, assigning or transferring, or offering to sell, assign or transfer, any benefit or privilege of the Programme.

 

9.2 By submitting an application, each Member and Applicant represents, warrants and undertakes to Chow Tai Fook that:

i) the Member or Applicant has provided or will provide, as and when required by the Terms, to Chow Tai Fook all information and details required by the Terms and by Chow Tai Fook in its discretion for the purposes of offering and maintaining the Programme;
ii) all information and details provided by the Member or Applicant and held by Chow Tai Fook and will at all times, be correct, complete and current (unless an application is rejected, in which case the obligation to update information and details ceases); and
iii) the Member or Applicant has read, understood, will comply with, and has the power and authority and legal right to agree to, all of the Terms.

10. LIABILITY AND WARRANTIES

10.1 Except as otherwise expressly provided in the Terms and to the greatest extent permitted by law, Chow Tai Fook is not liable (and excludes all liability) for any loss, damages or claims of any kind arising under, pursuant to or in connection with the Programme, including all:
i) direct, special, indirect, consequential, incidental or punitive damages; and
ii) damages for economic loss, loss of profits, loss of revenue, loss of goodwill, loss of bargain or opportunity, loss of anticipated savings or loss or corruption of data, whether in contract, tort(including without limitation negligence), in equity, under the statute, under an indemnity, based on fundamental breach or breach of a fundamental term or on any other basis, whether or not such loss or damage was foreseeable and even if advised of the possibility of the loss or damage.

 

10.2 Subject to section 10.3, any express or implied warranties, representations and statements given or made by Chow Tai Fook which relate to the Terms or their subject matter, and which are not specifically contained in the Terms, are excluded and disclaimed to the maximum extent permitted by law.

 

10.3 Nothing in the Terms excludes, restricts or modifies any condition, warranty, right or remedy implied or imposed by any statute or regulation which cannot lawfully be excluded, restricted or modified. If any condition or warranty is implied into the Terms under any law and cannot be excluded, and Chow Tai Fook is able to limit, restrict or modify the Member'sremedy for a breach of such a condition or warranty, then Chow Tai Fook's liability for breach of the condition or warranty is limited to the maximum extent permitted by law and Chow Tai Fook may, in its discretion, elect between any options available to Chow Tai Fook to remedy the breach of such a condition or warranty.

11. ENQUIRIES REGARDING THE PROGRAMME

Any questions regarding the Programme can be directed to Chow Tai Fook's Customer Relationship Management Division using the contact details set out below, as may be amended by Chow Tai Fook from time to time by notification to Members or by posting revised details on the Website.

12. PREVAILING LANGUAGE
In the event of any discrepancy between the Chinese version and the English version of the Terms, the English version shall prevail.
13. JURISDICTION
The Terms are governed by the laws of Hong Kong and each party hereby irrevocably submits to the exclusive jurisdiction of the courts of Hong Kong.
