We at Chow Tai Fook Jewellery Group Limited ("Chow Tai Fook") and our parent, subsidiary and/or affiliated companies within the Chow Tai Fook Jewellery group of companies (together the "Affiliates") value your personal data and privacy very highly. We know how important it is to protect your personal data. We pledge to comply with the requirements of all applicable data protection laws and regulations in relation to personal data protection.

The terms of this Global Personal Information Collection Statement (“Global PICS”) may be updated, revised, varied and amended from time to time as we deem necessary and the most current version will be the one available on our website https://www.chowtaifook.com/en-hk/ctf-club ("Group Website"). We will obtain your consent for changes to the terms of this Global PICS if such consent is required by applicable law. Any reference in these terms to "we", "us" and "our" is a reference to Chow Tai Fook and our Affiliates. Please read this Global PICS carefully to understand how we will handle your personal data.

Unless your express consent is required by applicable law, by providing us with your personal data (including by registering for membership of any of our customer or sales and marketing programmes owned, managed and/or controlled by us, registering to attend any of our events, participating in our interactive services or in any way communicating with us), you are accepting the terms of this Global PICS (including the updated terms referred to in the paragraph above) and consenting to our collection, retention, disclosure and use of your personal data, including transfer of your personal data overseas, as specified in this Global PICS. Further, we will only use and transfer your data for direct marketing purposes as specified in this Global PICS.In the event of any discrepancy or inconsistency between the English and other local language versions of the Global PICS, the English version will prevail.

The types of personal data that we collect will depend on the nature of your dealings with us. We may collect personal data from you by the following channels:

a.  when you register for membership of any of our customer or sales and marketing programmes owned, managed and/or controlled by us;

b. when you register to use, or enter information into, any of our interactive services (for example, our blogs and forums);

c. when you register to attend any of our events;

d. when you purchase goods and services from us or use services or products offered by us;

e. when you correspond with us; and

f. when you use the Group Website, other websites operated by our Affiliates  ("Affiliates Website" and, together with the Group Website, the "Website") or our official page on social media sites.

We may collect from you the following information which may contain personal data as defined under applicable data protection laws and regulations:

a. account registration information, including your name, gender, date, month and year of birth, age group, title, contact numbers (telephone, fax, mobile), postal address and email address;

b. billing information, transaction and credit card information (if you make a purchase from us);

c. shipping information (if you make a purchase from us);

d. records of correspondence between you and us;

e. optional information about your place of residence, marital status, occupation, personal monthly income, personal or professional interests, demographics, experiences with our products and services and contact preferences in order to provide you with further information about our products and services;

f. we may also take photographs and record videos of you during our events; and

g. if you register for CTF Club or other loyalty programme offered by us, we will also process your membership information such as membership tier, membership status, purchase history, and points accumulation and redemption history.

We generally do not collect sensitive personal data. However, we may only collect, use, and/or disclose sensitive data on the basis of your explicit consent or where permitted by law.

We generally do not knowingly collect personal data from minors or other individuals who are not legally capable of providing valid consent under applicable law. Where required by applicable law, we will obtain consent from a parent, guardian or other legally authorised representative before collecting, using or disclosing such personal data. If we become aware that personal data has been collected without the required consent or authorisation, we will take appropriate steps to investigate the matter and, delete the personal data, obtain the necessary consent or authorisation, or otherwise cease the relevant processing, as required by applicable law.

If you provide personal data of any third party to us, please provide this Global PICS for their acknowledgement and/or obtaining consents where applicable.

Your personal data may be used for the following purposes:

a. to offer you with our products and services, including sending you marketing and promotional materials, personalised communications and product recommendations, event information and e-shopping items relating to our products and services;

b. to conduct joint promotion events including notifying you of sales and marketing offers and sending you sales and marketing materials relating to the promotional offers or events of our affiliated, associated, related, subsidiary companies and/or companies under the common control of our ultimate holding company (“Group Companies”) and independent commercial entities (together with Group Companies, the “Business Partners”), which may be located outside Hong Kong, in relation to the following products, services and/or businesses:

c. to process your application for membership under any of our programmes and maintaining and managing your membership;

d. to provide you with rewards, vouchers or services under any of our programmes;

e. to handle and follow up with customer service calls, enquiries and complaints;

f. to send you administrative notices and communications relevant to your use of our Website and to respond to your enquiry or request ;

g. to perform research or statistical analysis in order to improve our goods and services  and for sales and marketing purposes;

h. to verify your identity and your eligibility to participate in our programmes;

i. to obtain statistics about users of our Website to analyse site usage in order to help its further development;

j. to provide you with a log-in ID for our Website;

k. to make such disclosures as required by law;

l. for our public relation purposes, such as by posting photographs taken, and video recorded, during our events on our platforms and social media. Unless we have requested for and obtained your consent, the photographs and video recordings are taken in a general manner and are not intended to focus on any specific individual;

m. for our internal records on the organization of our events and audit-related purposes;

n. to monitor, detect, prevent and investigate fraudulent, unauthorised or illegal activities, and to safeguard the security of your account and our systems.

You are not obliged to provide the personal data as may be required by us. However, we may not be able to provide you with our products and services or our Business Partners' information, sales and marketing materials if you do not provide us with the requested data.

In the event that your personal data is required for the execution of the contract or for pre-contractual measures and you did not provide such personal data to us, we may not be able to proceed with your request to enter into a contract with us, or may not be able to perform our obligation under the contract with you, either in whole or in part. For example, we may not be able to allow you to use our services or register for CTF Club or other loyalty programme. Similarly, if you do not provide us with personal data which is required for the compliance with law, it may result in us and/or you being in violation of the applicable law, in which case, we may take necessary actions to prevent the violation.

We do not sell, rent or trade your personal data to or with third parties including our Business Partners. However, your personal data may be disclosed or transferred by us to the third parties described below:

a. third party suppliers of goods and services (whether in Hong Kong or abroad) engaged by us to assist with providing you our services (including marketing analysis and research, data entry, management of our customer database, distribution of our sales and marketing materials, products rewards, vouchers and customer service) ("Third Party Service Providers"). Our Third Party Service Providers are under a duty of confidentiality and contractually bound to use your personal data in connection with the purposes specified in the Global PICS, and not for their own purposes (including direct marketing);

b. competent court of law, law enforcement agencies and/or regulatory bodies for compliance with applicable laws and regulations and protection of our legal rights; and

c. our distributors for our purposes specified at paragraph 2 above, and not for their own purposes.

Where required under applicable law, we will obtain your consent before sharing or disclosing your personal data. We will take appropriate steps to protect your personal data in accordance with applicable laws and regulations.

We may use systems, service providers and technology infrastructure located in different countries or regions to provide our services. Your personal data may be transferred to, stored in, accessed from, or otherwise processed in multiple jurisdictions, including Hong Kong, Macau, Chinese Mainland, by us or by the categories of third parties, as described below:

a. Group Companies and Business Partners to offer you with our products and services in multiple jurisdictions;

b. third party suppliers of goods and services (whether in your jurisdiction or abroad) engaged by us to assist with providing you our services (including marketing analysis and research, data entry, management of our customer database, distribution of our sales and marketing materials, products rewards, vouchers and customer service) ("Third Party Service Providers"). Our Third Party Service Providers are under a duty of confidentiality and contractually bound to use your personal data in connection with the purposes specified in the Global PICS, and not for their own purposes (including direct marketing); and

c. competent court of law, law enforcement agencies and/or regulatory bodies for compliance with applicable laws and regulations and protection of our legal rights.

Such personal data will be accessible only by us or the personnel of the third parties listed for the relevant purposes listed in paragraph 2, who will be instructed to observe confidentiality duty and the terms of this Global PICS  when accessing such personal data. We will implement appropriate safeguards to ensure that your personal data is adequately protected under applicable laws. Where required by applicable laws and regulations, we will conduct cross-border transfers of personal data in accordance with applicable transfer mechanisms.

We will not keep personal data longer than is legally permitted pursuant to applicable data protection laws and regulations. We will purge unnecessary personal data from our system in accordance with our internal procedures.

Under applicable data protection laws, as amended from time to time, you have the right to request access to, and to request correction of, your personal data held by us. In the event that you wish to exercise your right as set out above, we may request you to provide personal details in order to verify your identity. We will endeavour to respond to your request in accordance with requirements under applicable data protection laws and regulations, and we may charge you a reasonable fee for complying with your access request as permitted under applicable law.

As noted above, we may, from time to time, send you sales and marketing materials and information regarding our or our Business Partners' products and services as stated in paragraphs 2(a) & (b) based on your name and contact details that you have provided to us. However, we will not use your personal data unless we have received your consent. Suitable measures are implemented to make available to you the option to "opt-out" or “opt-in” as required by applicable law of receiving such sales and marketing materials at the time you provide us with your personal data.

Protection of your personal data collected is a priority for us. We will always strive to ensure that your personal data will be protected against unauthorised access. Although we will do our best to protect and secure your personal data, we cannot guarantee the security of your personal data transmitted over the internet or any telecommunications networks.

This Macao Addendum (“Addendum”) forms part of and supplements the Chow Tai Fook Jewellery Company Limited (“Chow Tai Fook”) Global Personal Information Collection Statement (“Global PICS”) in relation to the collection, use, disclosure, and processing of personal data of individuals located in Macao. It sets out the provisions required to comply with legal and regulatory requirements in Macao and is intended to amend, replace or supplement relevant sections of the Global PICS, where necessary. In the event of any conflict between this Addendum and the Global PICS, the terms of this Addendum shall prevail in respect of personal data processed in Macao.

The purpose of this Addendum is to inform you of how we manage personal data in accordance with the Personal Data Protection Act 8/2005 of Macao (“PDPA”).

Your Rights in relation to Your Personal Data

Subject to applicable laws and exceptions thereof, you may have the following rights to:

Right of access to your personal data: You may have the right to access your personal data to enable any applicable correction, where the personal data is inaccurate, incomplete, misleading or not up-to-date.

Right to correct your personal data: You may have the right to make the necessary correction to your incomplete, inaccurate, misleading, or not up-to-date personal data.

Right to object: You may have the right to object to certain processing of your personal data, such as objecting to processing on legitimate and compelling grounds relating to your particular situation or objecting to direct marketing.

Right to restrict automated processing of your personal data: You may have the right not to be subject to decisions based solely on automated processing of your personal data, including profiling, that have legal or similarly significant effects on you.
