CHOW TAI FOOK MEMBERSHIP
TERMS AND CONDITIONS

These terms and conditions apply to the Chow Tai Fook Membership Programme in Singapore (“Programme”). It is the responsibility of any person applying to be a member (“Applicant”) and each member of the Programme (“Member”) to read and understand them.


These terms and conditions must be read in conjunction with any other terms and conditions set out in any membership card, the Programme website www.ctfclub.com.hk (“Website”) and the terms and conditions as stated in other documents and the Privacy Statement as provided by Chow Tai Fook Jewellery Company Limited and/or its subsidiaries or affiliates (collectively “Chow Tai Fook”) from time to time (together, including these terms and conditions, the “Terms”).


By submitting a completed Application Form or otherwise becoming a Member, an Applicant acknowledges that he/she has read, understood and agreed to comply with all of the Terms.

1. OVERVIEW OF THE PROGRAMME AND GENERAL TERMS AND CONDITIONS

1.1 The Programme is offered and managed by Chow Tai Fook.

 

1.2 The Programme offers different membership tiers, including Basic, Gold, Platinum and Diamond memberships.

 

1.3 Without limiting Chow Tai Fook’s rights under the Terms, in particular its rights of suspension and termination, Members must comply with all of the Terms in order to maintain their memberships and enjoy the benefits and privileges granted to Members.

1.4 Chow Tai Fook reserves the right to amend, supplement or otherwise revise the Terms at any time without any prior notice to Members. In the event of any inconsistencies between the Terms, the terms and conditions as set out on the Website will prevail, unless specifically stated otherwise. Use of the Website is further subject to the legal and privacy terms found on the website of Chow Tai Fook.

 

1.5 Membership and membership cards are not transferable and may only be used by the named Member. Misuse of membership cards or Programme benefits and privileges may result in the suspension or termination of membership or the withdrawal or forfeiture of benefits and privileges (including accrued benefits and rewards).

 

1.6 Members are required to inform Chow Tai Fook of any change in personal particulars as soon as reasonably practicable, but always in accordance with the Terms. Members can go to any Chow Tai Fook store in Singapore (“Chow Tai Fook Store”) by completing the “Member Information Update Form” and returning the completed form to any Chow Tai Fook Store.

 

1.7 Programme membership and information relating to membership such as the amount of a Member’s Qualifying Spending (as defined below) will be kept in Chow Tai Fook’s records and such records will be conclusive evidence and the sole basis for the calculation and determination of all Member benefits and privileges.

 

1.8 In the event of any dispute arising out of or relating to the Programme or individual membership, Chow Tai Fook reserves the right to make sole and final decisions.

2. ELIGIBILITY FOR MEMBERSHIP AND APPLICATIONS

2.1 Any individual, natural person aged 18 or above who makes a single-item purchase at or above the amount specified by Chow Tai Fook from time to time (excluding watches, gift vouchers, pure gold nuggets, corporate gift orders and deposits) at any Chow Tai Fook Store may apply to become a Basic Member and start to accumulate spending to qualify for a higher membership status (“Qualifying Spending”) or, if the Applicant already meets the requirements for Gold, Platinum or Diamond membership, the Applicant may apply for such applicable membership tier instead.

 

2.2 Membership in the Programme is for individual, natural persons only. Joint or duplicate applications, or applications made by or on behalf of any companies, corporations, partnerships, businesses, legal entities or other organisations will not be accepted.

 

2.3 Members can enroll in both the Programme and the Chow Tai Fook membership programme in other areas. However, each programme and membership is unrelated and independent of the other, and the accumulated spending cannot be used or combined with the other. For the avoidance of doubt, the accumulated Qualifying Spending in each membership account shall be calculated separately and without consideration of the other.

 

2.4 To apply for membership, the Applicant must complete and sign the Application Form available at any Chow Tai Fook Store. The Applicant must present his/her Qualifying Spending receipt together with the completed Application Form, and must return the completed Application Form to a Chow Tai Fook Store for the form to be processed.

 

2.5 Chow Tai Fook reserves the right not to consider or process any incomplete, incorrect and/or unsigned Application Form.

 

2.6 Chow Tai Fook has the sole and final right to approve or reject any membership application regardless of whether an Applicant has met any or all of the criteria for membership.

3. ISSUANCE AND REPLACEMENT OF MEMBERSHIP CARDS

3.1A membership card will be issued following Chow Tai Fook’s approval of an application.
 

3.2 The membership card can be used in any Chow Tai Fook Store.

 

3.3 Members must present their valid membership card prior to payment in order to enjoy the benefits and privileges of the Programme.

 

3.4 To replace a membership card, a Member may visit any Chow Tai Fook Store with his/her valid photo-bearing identity document and fill out an application form for the replacement of membership card.

 

3.5 Membership cards shall be replaced only within their period of validity.

 

3.6 After verifying the information of the Member, the previous membership card will be deactivated immediately. Members can collect the new membership card at any Chow Tai Fook Store.

 

3.7 Accumulated Qualifying Spending will be transferred from the previous card to the replacement card based on Chow Tai Fook’s records. No Qualifying Spending will accumulate and be counted during the period of card replacement.

4. MEMBERSHIP PERIOD; QUALIFYING SPENDING AND MEMBERSHIP UPGRADE, DOWNGRADE AND RENEWAL

4.1A Member’s Qualifying Spending is accumulated within the membership period applicable to the Member’s membership tier (“Membership Period”). Other than Basic membership, the Membership Period for the Gold, Platinum and Diamond membership tier is valid until 31st December of the following year from the date of Chow Tai Fook’s approval of an application or membership upgrade as the case may be (based on Chow Tai Fook’s records). The Membership Period for Basic membership continues until the Basic membership is terminated or upgraded.

 

4.2 Qualifying Spending:

i) must be made in a Chow Tai Fook Store and cannot be made through any other channels;

ii) excludes watches, gift vouchers, pure gold nuggets, corporate gift orders and deposits (and any other item determined by Chow Tai Fook from time to time in its sole discretion);

iii) to be accumulated, requires presentation of a valid membership card prior to purchase and purchases of qualifying items must be claimed as Qualifying Spending by the Member on the day of purchase by the presentation of same-day receipt(s). For the avoidance of doubt, any spending which is not claimed on the same day of purchase will be forfeited and will not be subsequently credited to the membership account as Qualifying Spending; and

iv) shall be debited and deducted from the Member’s Qualifying Spending balance for any void or buy-in transactions.

 

4.3 All Qualifying Spending is non-transferable and accumulated Qualifying Spending amongst different membership accounts cannot be combined.

 

4.4 At the end of each Membership Period, or after any downgrade of a membership tier, the Member’s Qualifying Spending balance will be reset to zero.

 

4.5 Members will be immediately upgraded to a new membership tier on accumulation of the required Qualifying Spending for the relevant membership tier.

 

4.6 Once a membership is upgraded or downgraded, the effective new membership period will be valid until 31st December of the following year from the date of upgrade or downgrade, whichever is applicable (except for Basic Members who enjoy an unlimited Basic membership period).

 

4.7 Apart from Basic Members, membership will automatically be renewed until 31st December of the following year for all Members who have accumulated the relevant Qualifying Spending required for that membership tier within the relevant Membership Period. Otherwise, the membership will be downgraded for one membership tier. For the avoidance of doubt, a Gold Member who is downgraded will be downgraded to a Basic Member.

 

4.8 For membership upgrades, downgrades or renewal, the existing membership card will typically be deactivated 45 days after the effective date of membership upgrade, downgrade or renewal. Members shall collect their membership cards at Chow Tai Fook Store where they apply for membership upgrades, downgrades or renewal.

5. MEMBERSHIP TERMINATION AND SUSPENSION

5.1 Chow Tai Fook makes no warranty or representation as to the availability of the Programme or its duration or continuity and may, in its absolute discretion, suspend or terminate the Programme and/or any membership at any time without any liability arising by reason of such action.

 

5.2 Chow Tai Fook may, in its sole discretion, immediately without notice suspend or terminate the membership of any Member who fails to comply with the Terms. Upon the termination of any membership, all Qualifying Spending, benefits and privileges accrued under the membership shall be cancelled and be null and void.

6. REDEMPTION OF BONUS GIFTS

6.1 If Members intend to redeem the bonus gifts at a particular month before expiration of the membership, please visit Chow Tai Fook Store to complete the redemption process.

 

6.2 The required redemption points of the bonus gifts will be deducted instantly upon application of the redemption, such redemption points cannot be re-used and re-issued, and Members are required to sign the redemption receipt in order to confirm the completion of the redemption process.

 

6.3 Members must present the original membership card for verification for redemption of the bonus gifts, otherwise the redemption process cannot be accepted.

 

6.4 Members shall immediately upon receipt of the bonus gifts verify that the bonus gifts are in order and not defective, all redeemed bonus gifts cannot be returned.

7. REDEMPTION OF BONUS GIFTS OR OTHER ITEMS ON BEHALF OF THE MEMBERS

7.1 If Members are not available to collect their bonus gifts or other Programme items , Members can authorise a third party to collect on behalf of them as follows:.

i) Submit the original signed “Chow Tai Fook Membership Program Redemption Authorization Form”;

ii) Present and submit a copy of the Chow Tai Fook membership card; and

iii) Present the original identity document of the authorized person.The redemption will not be accepted without the above documents.

 

7.2 The authorized person shall immediately upon receipt of the bonus gifts verify that the bonus gifts are in order and not defective, all redeemed bonus gifts cannot be returned.

8. ENQUIRIES IN RESPECT OF ACCUMULATED QUALIFYING SPENDING

Members can check their Qualifying Spending by visiting any Chow Tai Fook Store.

9. PERSONAL DATA
Chow Tai Fook will collect, use, disclose or transfer a Members’ personal data in accordance with the Privacy Statement published on its website at www.ctfclub.com.hk.
10. MEMBER OBLIGATIONS AND WARRANTIES

10.1 Members must not:

i) act in any way in breach of the Terms; or

ii) abuse or misuse the Programme, or any of their benefits or privileges offered or gained under the Programme, including:

(a) engaging in illegal or fraudulent activities;

(b) supplying or attempting to supply false or misleading information;

(c) making a misrepresentation to Chow Tai Fook or any of its subsidiaries or affiliated companies; or

(d) selling, assigning or transferring, or offering to sell, assign or transfer, any benefit or privilege of the Programme.

 

10.2 By submitting an application, each Member and Applicant represents, warrants and undertakes to Chow Tai Fook that:

i) the Member or Applicant has provided, or will provide, as and when required by the Terms, to Chow Tai Fook all information and details required by the Terms and by Chow Tai Fook in its discretion for the purposes of offering and maintaining the Programme;

ii) all information and details provided by the Member or Applicant and held by Chow Tai Fook is and will at all times, be correct, complete and current (unless an application is rejected, in which case the obligation to update information and details ceases); and

iii) the Member or Applicant has read, understood, will comply with, and has the power and authority and legal right to agree to, all of the Terms.

11. LIABILITY AND WARRANTIES

11.1 Except as otherwise expressly provided in the Terms and to the greatest extent permitted by law, Chow Tai Fook is not liable (and excludes all liability) for any loss, damages or claims of any kind arising under, pursuant to or in connection with the Programme, including all:

i) direct, special, indirect, consequential, incidental or punitive damages; and

ii) damages for economic loss, loss of profits, loss of revenue, loss of goodwill, loss of bargain or opportunity, loss of anticipated savings or loss or corruption of data, whether in contract, tort (including without limitation negligence), in equity, under statute, under an indemnity, based on fundamental breach or breach of a fundamental term or on any other basis, whether or not such loss or damage was foreseeable and even if advised of the possibility of the loss or damage.

 

11.2 Subject to section 11.3, any express or implied warranties, representations and statements given or made by Chow Tai Fook which relate to the Terms or their subject matter, and which are not specifically contained in the Terms, are excluded and disclaimed to the maximum extent permitted by law.

11.3 Nothing in the Terms excludes, restricts or modifies any condition, warranty, right or remedy implied or imposed by any statute or regulation which cannot lawfully be excluded, restricted or modified. If any condition or warranty is implied into the Terms under any law and cannot be excluded, and Chow Tai Fook is able to limit, restrict or modify the Member’s remedy for a breach of such a condition or warranty, then Chow Tai Fook’s liability for breach of the condition or warranty is limited to the maximum extent permitted by law and Chow Tai Fook may, in its discretion, elect between any options available to Chow Tai Fook to remedy the breach of such a condition or warranty.

12. ENQUIRIES REGARDING THE PROGRAMME

Any questions regarding the Programme, Members can visit any Chow Tai Fook Store.

13. PREVAILING LANGUAGE
In the event of any discrepancy between the Chinese version and the English version of the Terms, the English version shall prevail.
14. JURISDICTION
The Terms are governed by the laws of Singapore and each party hereby irrevocably submits to the exclusive jurisdiction of the courts of Singapore.
